Workplace Investigation
Whether you're a small, medium or large business when the matter of either an external or internal breech or offence has been committed or you suspect criminal acts have occurred , you are compelled to act. Business owners must protect their business by law and ensure they run it in a compliant manner. YA have had many years of discussing sensitive issues with companies. Investigations come in many forms. You will be able as an employer to consult the ACAS codes of practice. However, what they will not do is act on your behalf. They will not take statements for you or help construct a search and drugs policy. They will not advise you on CCTV or take witness statements. Nor will they act as your liaison with the police or other agencies. We do!
However, it doesn’t stop there. We will examine how the matter or incident occurred. Where the potential for liability lies. And above all what measures you can put in place to ensure it doesn’t happen again. Please remember if you fail to act or correct processes you could also be committing offences (see Bribery Act 2010)
